Injuries from sidewalk slip and falls can be terrible

More than a month ago, we wrote a post that talked about premises liability. Today, we want to get a bit more specific and talk about sidewalk accidents. A story out of Santa Monica has caught our eye, as it exemplifies the dangers of sidewalk accidents and the role that cities and municipalities can play in them.

You may think of sidewalk accidents as simple trip and falls where minor or no injuries occur. But this isn't true. Many sidewalk accidents leave the victim injured, and sometimes the harm is serious. In this Santa Monica case, a woman tripped and fell on a two-inch differential between two slabs of concrete on the sidewalk. The fall left her with a dislocated shoulder that required surgery.

The city recently approved a settlement in the lawsuit for $48,000, a wise move by the city considering it was found that the sidewalk in question was one of 3,000 that Santa Monica had marked for repairs. And yet no repairs were done. Worse still, there are questions about an inspection of the sidewalk that occurred before the accident. The inspector claimed that the differential between the two concrete slabs was only an inch. So was the inspection botched? Or did the sidewalk get worse? Either way, something should have been done much sooner.

Cities and municipalities can be held responsible for damaged or unsafe sidewalks. When an accident occurs due to an unsafe sidewalk, consider your legal options.
