Exploring the legal area of premises liability

A couple of months ago, we wrote a post about a slip and fall where a woman suffered serious injuries. Slip and falls are harmful incidents that are common in the realm of personal injury and premises liability law. However, today we want to focus on some of the other areas of premises liability that can cause people to needlessly suffer.

One common area of premises liability that comes up often is a lack of proper security at a restaurant or place of residence. More specifically, a restaurant may have excessively aggressive security that harms an individual; they could have lax security that contributes to a person's injuries; or they could not have security at all, which also contributes to a person's injuries.

The physical structure can also be in a state of decay that causes certain dangerous condition to arise. The carpeting could tear up and cause someone to trip and fall. Pieces of the building could break off and fall on people. Pieces of equipment or shelving could fall off the wall due to shoddy work. All of these circumstances are examples of dangerous conditions that landlords or property managers should address, and when they fail to do so, they can make themselves liable.

Continuing on this topic, decaying building -- or even clean-looking ones -- can host mildew, mold and other pathogens or biological agents that adversely affect the inhabitants or guests of that building.

In any of these cases, it is imperative for the victims to consult with an attorney as soon as possible to ensure the evidence is preserved in the case and to make sure that their case proceeds appropriately.
