Treasury Dept: Florida no long messing up anti-foreclosure program

Despite concerns over a federal program’s effectiveness in preventing home foreclosures in Florida, federal officials insist that the state government has fixed any problems. That hopefully means that more homeowners in the state will get the chance to save their houses.

The News-Press reports that Sen. Bill Nelson asked the Treasury Department to investigate the federal Hardest Hit Fund after a news story in January uncovered problems with it in Florida. Among the report’s findings was that state officials were taking too long to process applications and excluding too many homeowners from potential relief.

After an investigation, the special inspector general for the Troubled Asset Relief Program, or TARP, of which the Hardest Hit Fund is a part, joined Nelson in his concern. But in a letter detailing its findings, Treasury assured Nelson that much of the foot-dragging or unjust exclusions by Florida officials in administrating the program have been taken care of.

The letter said that “many off the issues” from the TARP inspector general’s probe prove have since been taken care of. The federal agency promised to continue “regular oversight” to make sure those responsible for Hardest Hit in Florida do what they can to prevent as many home foreclosures as possible.

While this federal fund may be able to help, it is not the only option. An experienced foreclosure defense attorney will have more than one tool in his or her bag. He or she will examine the foreclosure filing for procedural errors, which can get the case dismissed. He or she may be able to negotiate a settlement, short sale, or other resolution.
